If you’re thinking about becoming a gestational surrogate, it’s important to understand the qualifications—and the reasons you may not be eligible.
12 Reasons You May Not Qualify for Surrogacy
1. You do not live in the U.S. or reside in a surrogacy-restricted state
We only work with surrogates who live in surrogacy-friendly states within the United States. Some states have legal restrictions that make it difficult or impossible to proceed with a safe, legally protected journey.
2. You do not have legal U.S. citizenship or residency
Surrogacy involves legal contracts and compensation, so you must have legal status to live and work in the U.S. This is required to comply with U.S. laws.
3. Your partner does not support your decision
If you’re married or in a committed relationship, your partner needs to be fully on board. Their support is important not only for legal reasons but also for your emotional and logistical support throughout the journey.
4. You have a history of pregnancy complications
If you’ve experienced serious complications in past pregnancies—like preeclampsia, preterm labor, or gestational hypertension—you may be at higher risk during surrogacy. We always put the health of our surrogates and the baby first.
5. You have a mental health condition that requires medication
We require surrogates to be in stable mental health. If you are currently taking medication for depression, anxiety, bipolar disorder, or other psychiatric conditions, this may affect your eligibility.
6. You have a criminal record
All surrogates (and their partners, if applicable) must pass a background check. A clean legal record is required to ensure the safety and trust of everyone involved.
7. You smoke, use marijuana, or recreational drugs
Surrogates must be completely free from smoking, vaping, marijuana (including edibles), and all illegal drug use. This includes during the screening process and throughout the entire journey.
8. You consume alcohol heavily
Surrogacy requires a healthy, stable lifestyle. Heavy alcohol use is not safe for pregnancy and is not permitted during the surrogacy process.
9. You are only interested in surrogacy for the money
While surrogates are fairly compensated, it’s important that your motivation also comes from a genuine desire to help a family grow. Surrogacy is not just a financial opportunity—it’s a deeply personal journey.
10. You are financially unstable
We look for surrogates who are already financially stable. If you are in a difficult financial situation or view surrogacy as a last resort for income, it may not be the right time for you to apply.
11. You aren’t fully committed to the process
Surrogacy requires time, effort, and dedication. From medical screenings and embryo transfer to doctor’s appointments and legal steps, you’ll need to follow medical guidance closely and stay engaged the entire time.
12. You don’t have custody of your children
To be eligible, surrogates must have full custody of their own children. This shows that you have personal experience with pregnancy and parenting, which is a key part of being a strong candidate for surrogacy.
